Conditions of participation for melumé skinscience sweepstake
The organiser of the sweepstake is melumé skinscience, Köhlershohner Straße 60, 53578 Windhagen, e-mail: customer-service@melume-skinscience.com. Participation in the melumé skinscience sweepstake is free of charge and is governed solely by these terms and conditions.
1. procedure of the sweepstake
The duration of the sweepstake is from March 8th - March 10th, 2024. During this period, users on Instagram will have opportunity to take part in the competition online.

In order to participate in the sweepstake, it is necessary to place an order in the Melumé Skinscience webshop between March 8 and March 10. After that, participation in the competition is automatically.
Participation in the sweepstake is free of charge.
3. eligibility
Natural persons who are have reached the age of 18 are eligible to participate. Participation is dependent on the purchase of one or more items in the Melumé Skinscience webshop.
Should a participant be restricted in his/her legal capacity, the consent of his/her legal representative is required.
All persons involved in the conception and implementation of the sweepstake and employees of melumé skinscience as well as their family members are not eligible to participate in the sweepstake.
In addition, melumé skinscience reserves the right, at its own discretion, to exclude persons from participation if there are justified reasons, for example:
(a) tampering with access to or conduct of the sweepstake;
(b) breach of these terms and conditions;
(c) acting unfairly; or
(d) providing false or misleading information in connection with participation in the sweepstake.
4. prize, notification and transmission of the prize
The following prizes will be awarded:

The winners will be drawn at random from all participants who placed an order before March 10, 23:59 o’clock.
The winners of the prize draw will be informed of the prize in a timely manner by a separate e-mail.
The prize will only be handed over to the winner or the legal representative of the underage winner. An exchange, self-collection or cash payment of the prize is not possible.
Any costs incurred for the dispatch of the prizes will be borne by the operator. Any additional costs associated with claiming the prize, such as customs duties, shall be borne by the winner. The winner is responsible for any taxation of the prize.

5 Termination of the sweepstake
melumé skinscience expressly reserves the right to terminate the sweepstake without prior notice and without giving reasons. This applies in particular to any reasons that would disrupt or prevent the sweepstake from running as planned.
6. data protection information
Personal data of the participant will be used exclusively for the execution of the sweepstake contract, i.e. for the determination of the winners and delivery of the prizes (legal basis: Art. 6 para. 1 lit. b) GDPR) and will subsequently be deleted 3 months after redemption of the sweepstake prize. Any further use of the data for advertising purposes will only take place if the participant consents (legal basis: Art. 6 para. 1 lit. a) GDPR).
In the event of a win, the winner agrees to the publication of his/her name and place of residence in the advertising media used by melumé skinscience. This includes the announcement of the winner on melumé skinscience's website and its social media platforms.
You have the right to revoke your consent to the processing of data at any time with effect for the future. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.
In addition to the right to revoke your consent given to us, you are entitled to the following further rights if the respective legal requirements are met:

7 Social media disclaimer
Insofar as a sweepstake is carried out or announced on social media platforms (in particular Facebook, Twitter, Deezer, Spotify, Instagram, Youtube), the participant acknowledges that the sweepstake is in no way connected to the social media platform in question and is in no way sponsored, supported or organised by it. Furthermore, the participant declares that he/she will not make any claims against these social media platforms on account of the sweepstake and that he/she will release them from any liability in this respect.
8 Liability
Claims for damages by the participant are excluded. Excluded from this are claims for damages by the participant arising from injury to life, limb or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by melumé skinscience, its legal representatives or vicarious agents. Material contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract. In the event of a breach of material contractual obligations, melumé skinscience shall only be liable for the foreseeable damage typical of the contract if this was caused by simple negligence, unless it is a matter of claims for damages by the participant arising from injury to life, limb or health. The aforementioned restrictions also apply in favour of melumé skinscience's legal representatives and vicarious agents if claims are asserted directly against them. The provisions of the Product Liability Act remain unaffected.
9 Applicable law and place of jurisdiction
melumé skinscience's sweepstake is subject exclusively to the law of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Legal recourse is excluded.
10 Severability clause
Should individual provisions of these conditions of participation be or become invalid, this shall not affect the legal validity of the remaining conditions of participation.
